1. Agreement to Terms

By downloading, installing, or using MTC Practice ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

The App is provided by Kresko Ltd ("we", "us", "our"), a company registered in England and Wales.

2. Description of Service

MTC Practice is an educational mobile application designed to help Year 4 children (ages 8-9) practise multiplication tables in preparation for the UK Multiplication Tables Check (MTC). The App provides:

• Practice questions in the official MTC format
• Progress tracking and score history
• Accessibility features for users with special educational needs
• Teacher tools for classroom delivery (with purchase)

The App is not affiliated with, endorsed by, or connected to the UK Department for Education or the Standards and Testing Agency.

3. User Eligibility

The App is intended for:

• Children using the App under the supervision of a parent, guardian, or teacher
• Parents and guardians managing their children's practice
• Teachers and educators using the App for classroom instruction

By using the App, you confirm that you are either an adult (18 years or older) or are using the App with appropriate adult supervision.

4. Purchases and Payments

The App offers optional in-app purchases:

• Home Practice (£2.99) - Unlimited practice for home use
• Teacher Tools (£9.99) - Full features including classroom delivery tools

All purchases are:

• One-time payments - No subscriptions or recurring charges
• Non-consumable - Purchase once, use forever on the same platform
• Processed by app stores - Payments are handled by Google Play or Apple App Store

Refund requests must be directed to the respective app store (Google Play or Apple App Store) in accordance with their refund policies.

5. Licence to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to:

• Download and install the App on devices you own or control
• Use the App for personal, educational, or classroom purposes

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the App for any commercial purpose beyond classroom teaching
• Sublicense, rent, lease, or lend the App to third parties

6. Intellectual Property

The App and all its contents, including but not limited to text, graphics, logos, icons, images, audio, and software, are the property of Kresko Ltd and are protected by UK and international copyright, trademark, and other intellectual property laws.

"MTC Practice" and associated logos are trademarks of Kresko Ltd.

7. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Supervise children's use of the App appropriately
• Not attempt to gain unauthorised access to the App or its systems
• Not use the App in any way that could damage, disable, or impair its functionality

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Specific educational outcomes or test results

While we strive to accurately replicate the MTC format, we cannot guarantee that the App exactly mirrors the official assessment. The App is a practice tool and should be used as part of a broader educational approach.

9. Limitation of Liability

To the fullest extent permitted by law, Kresko Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data stored on your device
• Educational outcomes or test performance
• Any damages arising from use or inability to use the App

Our total liability for any claims arising from these Terms or use of the App shall not exceed the amount you paid for the App.

10. Updates and Changes

We may update the App from time to time to add features, fix bugs, or improve performance. We may also modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

We reserve the right to discontinue the App at any time without notice, although we will endeavour to provide reasonable notice where possible.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
